Self-Assessment For Q-Mharc Gnó Le Gaeilge

Use of the Q-Mharc

Once the Q Mharc has been awarded it can be used for three years on i.e. products and merchandise of the business and displayed publicly by the business, subject to the following provisions:

Subject to the provisions of this all-island certification mark and current product/award/labeling/copyright regulations the designation Q-Mharc Gnó le Gaeilge shall not be used (whether on its own or in conjunction with other words) to describe the business/achievements of any organization that has not achieved the distinctive characteristics of Q-Mharc Gnó le Gaeilge and which does not comply with this all-Island certification mark as awarded by Foras na Gaeilge.

Foras na Gaeilge has, in case of breach of any provision of the Agreement, the right to withdraw the certificate mark concerned by the breach in question. If the applicant fails to cure said breach within thirty (30) days of the receipt of a written request to do so, containing an account of the invoked breach.

Foras na Gaeilge has the right to terminate the whole Agreement, thereby withdrawing all Certificates held by the Company, with immediate effect:

a) through a written notice from Foras na Gaeilge, if a major change in the rights of ownership or control of the Company or its business takes place;

b) through a written notice from Foras na Gaeilge, if the Company becomes insolvent, suspends payments, commences composition negotiations, goes into liquidation or the like; or

c) if the Company commits a material breach of any provision of the Agreement, such as, but not limited to non compliance with the criteria set out in section 2.0, and fails to cure said breach within thirty (30) days of the receipt of a written request to do so containing an account of the invoked breach.

d) no person may use the certification trademark except under and by virtue of award of the certificate mark by the awarding body.

e) any person who, not being the Company or certification holder, uses the Certification Mark in relation to any services whatsoever shall render himself liable to have legal action taken against him by Foras na Gaeilge.

Monitoring of Q Mharc

Q-Mharc Gnó le Gaeilge has a market surveillance department that monitors the use of the certification mark to safeguard its compliance with regulations.
